Filing Application

It takes years to build a brand. However, if it is not protected, it is bound to be misused. Trademark registration helps in distinguishing/ differentiating your products/ services with those of another. It also restrains/ prohibits other persons from using your trademark such as your logo/ brand name, etc. In India, you can trademark any Letter/s, Numeral/s, Word/s, Phrase/s, Logo, Graphic, Smell, Sound Mark or a Combination of Colours, device, etc., or a combination of these.

We will file your trademark application on your behalf after conducting a public search. A public search is a service provided by us free of cost, to enable you to choose a word/ logo that is easily distinguishable and distinct from marks already registered or applied for, in order to avoid objections from the registry/ third parties.

1. For Individuals/ Proprietors/ Micro and Small Firms/ Startup

  • Form TM-48 (Authorisation for the Trademark Attorney/Agent) on stamp paper (as applicable)
  • Identity Proof of the individual
  • Address Proof of the individual
  • MSME Registration for micro and small firms
  • Certificate under Start-up India Action Plan for Start-ups

2. For Companies, LLP, Partnership, etc.

• • Trademark Word/ Logo
  • Form TM-48 (Authorisation for the Trademark Attorney/Agent) on stamp paper (as applicable) along with Board Resolution
  • Identity Proof of the authorised signatory
  • Address Proof of the authorised signatory
  • Incorporation Certificate of the Company/ LLP or Partnership Deed

Fees

Our fees for filing your application is INR 999/-, which does not include the Government Fees, which shall be charged as per actuals. For micro/ small enterprises, start-ups, proprietorships and individuals, the application fee charged by the Government currently is INR 4,500/-, while for all other entities, it is INR 9,000/-.

What happens after the Application is filed?

As soon as the application is filed, an acknowledgement receipt is generated and you can start using a ‘TM’ symbol against your word mark/ logo, etc. However, your trademark is not yet registered. After submission, the Application is examined by the registry for any defects/ objections.

It takes anywhere from 12 to 18 months for the entire process to get completed, if there are no objections from the registry/ other person.

Once the trademark is registered, you can start using the ® symbol.

Is the trademark, once registered, valid for lifetime?

No. A trademark registration is valid for a period of 10 years from the date when the application is submitted and needs to be renewed every 10 years.
